Terms of Service

These Terms of Service ("Terms") govern your use of the BoxArts service at boxarts.app ("the Service"). BoxArts ("we", "us", "our") is a New Zealand-based service.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The short version: BoxArts is a paid web service for cataloging your PC game collection. You pay for it monthly or annually, you can cancel anytime, you own the content you upload, you must not use the Service for anything illegal, and we run it in good faith but make no warranties about uptime at this beta stage.

1. About the Service

BoxArts is a web application that lets you digitize and showcase your physical PC game collection. Features include:

  • A catalog for organizing your games, with editable metadata (title, year, publisher, notes, tags).
  • Image-editing tools tailored to box art: automatic background removal, perspective correction, dewarping, spine and slip-cover generation.
  • A 3D builder that assembles browsable shelf displays from your scanned art.
  • A per-user DOS playback module that turns DOS-game bundles you upload into browser-playable experiences via js-dos.

The Service is currently in beta. Features may change, be added, or be removed at our discretion as we iterate.

2. Account registration

  • You must provide a valid email address to register.
  • You are responsible for keeping your password confidential. We strongly recommend a unique password and using a password manager.
  • You are responsible for everything that happens under your account.
  • You must be at least 13 years old to use the Service. If you are under the age of legal majority in your jurisdiction, you confirm that a parent or guardian has reviewed and accepted these Terms on your behalf.
  • One person, one account. Sharing account credentials with others is not permitted; if you want to share your collection display, use the (forthcoming) public-share features rather than handing out your login.

3. Subscription plans, billing, and refunds

3.1 Plans

BoxArts is offered on three tiers:

  • BoxBasic — free, 2 GB of storage.
  • BoxStar — US$3.99 per month or US$39 per year, 50 GB of storage.
  • Big Box Boss — US$9.99 per month or US$99 per year, 250 GB of storage.

All amounts are in US dollars and exclude any applicable taxes. Stripe may collect sales tax, VAT, or GST on our behalf depending on your country of residence.

Storage caps apply to the total bytes of images and DOS-game bundles you have uploaded. If you exceed your cap, you'll receive an error on the next upload and a notice in the app — your existing content stays accessible, but new uploads are blocked until you delete content, upgrade, or contact us.

If you require more than 250 GB, contact hello@boxarts.app and we will discuss a custom plan.

3.2 Billing

  • Paid subscriptions are processed by Stripe. You authorize us (via Stripe) to charge your chosen payment method at the start of each billing period.
  • Monthly subscriptions renew every month; annual subscriptions renew every year. The renewal happens automatically until you cancel.
  • You can update your payment method or cancel anytime via the Account → Billing → Manage subscription link, which opens Stripe's secure customer portal.
  • If a payment fails, Stripe will retry over several days. If retries all fail, your subscription will be cancelled and your plan will revert to BoxBasic at the end of the billing period.

3.3 Refunds

We aim to be reasonable. Our default position is:

  • We do not automatically refund completed billing periods (i.e. if you cancel mid-month after being charged, your subscription stays active until period end and we don't pro-rate a refund).
  • If you believe you have been charged in error, or you've had a poor experience you'd like remedied, email hello@boxarts.app and we will consider it case-by-case. We typically respond within a few business days.
  • Under the New Zealand Consumer Guarantees Act 1993, you have additional statutory rights to remedies if our Service fails to meet the standards required by that Act. Those rights cannot be contracted out of.

3.4 Price changes

If we change subscription prices, we will:

  • Email existing paid subscribers at least 30 days before the change takes effect.
  • Honour your current price for the remainder of any billing period you've already paid for.
  • Allow you to cancel without penalty if you don't accept the new price.

4. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose, including the storage or distribution of content you don't have the right to use.
  • Upload content that infringes someone else's intellectual property, privacy, or other rights.
  • Upload malware, viruses, exploit payloads, or content designed to harm BoxArts or its users.
  • Probe, scan, or attempt to compromise the security of the Service or any related infrastructure.
  • Use automated tools (scrapers, bots, headless browsers) to access the Service beyond the access your own browser would generate, except for clearly identified backup tools or feed readers that respect our rate limits.
  • Resell access to the Service, white-label it, or use it to provide a competing service to third parties without our explicit written permission.
  • Share your account with other people. Each person should have their own account.
DOS-game uploads — important. BoxArts lets you upload DOS-game bundles for in-browser play. You are responsible for ensuring you have the legal right to use any game you upload. Each user's DOS catalog is private — you cannot share it with other users via BoxArts — but uploading commercial software you do not own a licence to is a breach of these Terms and may also be illegal in your jurisdiction. We do not actively monitor uploads but reserve the right to remove content and terminate accounts when we receive credible reports of infringement.

5. Your content

5.1 You own it

The images, DOS bundles, tags, notes, and other content you upload to BoxArts ("Your Content") remain yours. We do not claim any ownership interest in Your Content.

5.2 Licence to operate the Service

You grant us a limited, worldwide, royalty-free licence to host, store, transmit, process, and display Your Content solely for the purpose of providing the Service to you. This licence ends when you delete the content or close your account, subject to the retention periods in our Privacy Policy.

5.3 Backup responsibility

While we keep backups of the application database, you should retain your own copies of irreplaceable content (especially scanned box art and any DOS bundles you've put effort into preparing). We provide tools for bulk export of catalog data and can assist with content export on request.

6. Our intellectual property

  • The BoxArts name, logo, marks, codebase, and user-interface designs are owned by us. You may not copy, modify, or redistribute them without permission.
  • You may take screenshots of your own collection within the Service for personal, non-commercial use (e.g. social media). Use of the BoxArts logo for commercial purposes requires permission.

7. Third-party services

The Service runs on infrastructure operated by third parties (Stripe, Supabase, Cloudflare, Fly.io, Sentry — see our Privacy Policy for full disclosure). By using BoxArts you accept that we depend on these providers and that their availability, behaviour, and policies are outside our control.

8. Service availability

We aim to keep the Service available 24/7 but make no guarantee of uptime. The Service is provided on an as-is, as-available basis. This is normal for beta-stage services.

Specifically:

  • We may take the Service offline for planned maintenance with reasonable notice when feasible.
  • We may need to take it offline immediately for security or stability reasons, without notice.
  • We may change or remove features as we iterate.
  • We are not liable for losses arising from downtime, beyond what the New Zealand Consumer Guarantees Act 1993 requires.

9. Account termination

9.1 Termination by you

You can close your account at any time:

  • Cancel any active paid subscription via the Stripe customer portal.
  • Email hello@boxarts.app requesting account deletion. We will action this within 14 days.

9.2 Termination by us

We may suspend or terminate your account if:

  • You materially breach these Terms (e.g. uploading content that infringes others' rights, attempting to compromise the Service).
  • You haven't paid your subscription and the grace period has expired.
  • We are required to by law.
  • We discontinue the Service. We will give at least 30 days' notice and refund any unused portion of an annual subscription on a pro-rata basis.

Where reasonable, we will give you notice and a chance to remedy the breach before terminating.

10. Disclaimers and limitation of liability

The Service is provided as-is, without warranties of any kind, express or implied, except as required by the New Zealand Consumer Guarantees Act 1993 and other applicable consumer protection laws (which cannot be excluded).

To the maximum extent permitted by law, we are not liable for:

  • Indirect, incidental, consequential, special, or punitive damages.
  • Loss of profits, revenue, data, or goodwill.
  • Damages exceeding the total amount you paid us for the Service in the 12 months preceding the event giving rise to the claim, or NZ$200, whichever is greater.

Some of these limitations may not apply to you depending on your jurisdiction.

11. Indemnification

You agree to indemnify and hold harmless BoxArts and its operator from any claim or demand made by a third party arising out of:

  • Content you upload to the Service (e.g. a copyright holder claiming you uploaded their game without licence).
  • Your breach of these Terms.
  • Your violation of any law or the rights of a third party.

12. Governing law and disputes

These Terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of New Zealand, with the Auckland District Court as the first instance.

Before initiating any formal legal proceeding, we ask that you first email hello@boxarts.app and give us a reasonable opportunity to resolve the issue.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced via email to your account address at least 14 days before they take effect, and the "Effective" date at the top of this page will be updated. Continued use of the Service after a change becomes effective constitutes acceptance.

If you do not accept a change, you may cancel your subscription and delete your account before it takes effect.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
